Frequently asked questions (FAQ)

Frequently asked questions about residence authorization based on family reunification in Brazil

What is residence authorization based on family reunification, and what is its legal basis?

It is an authorization that allows a foreign national to reside in Brazil based on a family relationship recognized by law, such as that of a spouse, partner, child, parent, grandchild, grandparent or sibling. It is provided for in Articles 30(I)(i) and 37 of Law No. 13.445/2017, Article 153 of Decree No. 9.199/2017, and Interministerial Ordinance No. 12/2018. It may be granted if the family relationship is proven and the applicable legal and regulatory requirements are met.

I am in Brazil as a tourist. Can I apply for residence based on family reunification without leaving the country?

Yes. Foreign nationals in Brazil as visitors—including those holding a visitor visa or exempt from the visa requirement—may apply for residence authorization based on family reunification if they meet the legal requirements. They do not need to leave Brazil to obtain a consular visa in this category. This possibility is provided for in Articles 123 and 124 of Decree No. 9.199/2017.

Once your application has been duly filed, you have the right to remain in Brazil while awaiting a decision from the Brazilian immigration authority, pursuant to Article 4, item XV, of Law No. 13.445/2017. Our firm handles the procedure from assessing the family relationship and preparing documents through filing and monitoring the application, so you can await the decision in Brazil with your family.

After filing the application, can I remain in Brazil while awaiting the decision?

Yes. Article 4, item XV, of the Migration Law ensures the right to remain in Brazil while your residence authorization application is being processed. Your application must have been duly filed, and you must keep the corresponding proof of filing up to date whenever required. This protection allows you to remain in the country while your case is assessed, but it does not mean that residence has been approved.

My authorized stay as a tourist has expired. Can I still regularize my status?

Yes, provided you meet the requirements of the intended category. Article 31, § 5, of the Migration Law allows granting residence regardless of migration status. However, the expired stay requires analysis of possible fines, notices and other pending matters. Our lawyers assess these circumstances and the measures necessary to conduct your regularization.

What is the difference between a visa and a residence authorization?

A visa is generally applied for abroad and allows a foreign national to seek entry into Brazil. A residence authorization, by contrast, allows someone to establish residence in the country. If you are already in Brazil and meet the family-reunification requirements, you may apply to the competent Brazilian authority.

How do I know if I am entitled to family reunification or if another residence authorization category is more appropriate?

We analyze your family relationship, the family member’s situation in Brazil (the sponsoring family member), your nationality and your migration history. Spouses, partners, children, parents and other relatives provided for in the legislation may qualify, depending on the conditions of each case. We also verify whether applicable alternatives exist, such as residence under international agreements, work or study.

How long does the residence authorization by family reunification take?

The timeframe depends on the applicant’s documentation, appointment availability and any requirements from the Brazilian Federal Police. The official estimate is up to 180 calendar days to complete the residence authorization service, including delivery of the card. In our firm’s experience, cases are usually concluded within 60 to 120 days, depending on the particular circumstances of each case.

Which document will I receive after approval: RNM or CRNM?

RNM is the National Migration Registry number. CRNM is the Carteira de Registro Nacional Migratório (National Migration Registration Card), an identity document issued to immigrants registered in Brazil; it contains that number. Approval of residence and delivery of the card are distinct stages. Our lawyers advise on the steps necessary to complete the registration and obtain your documentation.

How do the office lawyers conduct my process?

Our immigration lawyers assess your eligibility, organize and check the documentation, coordinate sworn translations when necessary, and prepare and file your application. While your application is pending, they monitor its progress, respond to requests and keep you informed about the steps required under the services you engaged.

Who will handle my case?
